Terms and Conditions

These terms and conditions apply to your use of this Deejays Online website (Site), owned and operated by Deejays Ltd, including any service or content we provide you via the Site (together, called the Online Services).

While every endeavour has been made to supply accurate information, errors and omissions may occur. Accordingly, we do not accept any liability for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission, whether negligent or otherwise, contained on or accessed through the Online Services.

1. Agreement
By using the Site and or registering to receive any Online Services, you are deemed to have read and agreed to these term and conditions. If you do not agree to these terms and conditions, you should stop using the Online Services.

2. Deejays Online Account
Registration is required to access our Online Services. You can register on the Site by providing your email address and other requested information and creating your personal or business account. The email address, username and password are only for you and are not assignable or transferable to any other person.

You agree that you are solely responsible for any use of the Online Services, including access to your account, by any person using your credentials. You agree that all information you make available to us when registering or using the Online Services is accurate, up-to-date, complete and not false, or misleading.

If you are a Trade customer you further accept that, when ordering products using the Site, you have the authority to purchase products on behalf of your company, business, partnership, trust, club, institution, charity or community group and that you are bound by these terms & conditions.

You accept that, should you leave your organisation or its employment you will no longer access the Online Services using the access information for that organisation. Deejays Ltd accepts no responsibility for the misuse of the Sites logins by ex-employees or associates of its customers.

To the maximum extent permitted by law, we will not be liable, whether in contract, tort or otherwise, for any loss, damage or injury arising directly or indirectly from any use of the Online Services or your account, or any third party gaining unauthorised access to your personal information.

3. Access
You understand that we may at any time in our sole discretion and without prior notice to you, prohibit or restrict your access to the Online Services or your account.

We will use reasonable efforts to keep the Online Services virus free and from unauthorised access. We do not warrant that the Online Services or any files available for downloading by you will always operate uninterrupted or error-free or free from viruses or defects.

4. Content Ownership
Material that you see on the Online Services may be protected by copyright, trade mark, patent or other protections, even if it is not stated to be.

The Online Services contain intellectual property and other proprietary information. We either own or are authorised to use the intellectual property in everything that you have access to on the Online Services. You are not permitted to do anything which infringes these intellectual property rights unless you have express permission from us.

5. Linked Websites
Our website may contain links to other sites that are not under our control. These websites have their own privacy policies, and we encourage you to review them. We have no responsibility for linked websites, and provide them solely for your information and convenience.

6. You Must Not
You must not disrupt or interfere with the Online Services or its software and hardware. You must not break any relevant law which applies to the use of the Online Services. If you do any of these things or otherwise use the Online Services inappropriately or maliciously you will indemnify us for any loss we suffer in connection with what you have done.

7. Online Services Information
We will endeavour to keep information on the Online Services as accurate and up-to-date as possible. However, the Online Services may have some material which is not accurate or up-to-date in all respects and errors or omissions may occur.

Examples of these inaccuracies can include incorrect quantities on hand, zero rated pricing, incorrect pricing, inaccurate product sizes, descriptions and images.
For this reason, we do not warrant the accuracy or completeness of the information and, to the extent we are able to by law, we do not accept any liability for any errors on the Online Services.

We may update information on the Online Services without notice at any time.
Products and specials advertised on the Online Services are subject to availability and while stocks last.

We disclaim, as permitted by law, all liability for any damage or loss resulting from your reliance on and use of the Online Services or the information provided by the Online Services.

8. Terms and Conditions Amendments
We can change these terms and conditions at any time, without notice to you by updating them on the Site. The amended terms will take effect when they are posted and your continued use of the Online Services means you agree to our revised terms.

9. Delivery
We reserve the right to restrict deliveries by geographical area and to locations which are difficult or unsafe to access. We cannot deliver to a PO Box address.

Delivery will occur at your nominated delivery address. If there is no person to accept delivery, the products will be left at the front door or as instructed by you in your order.

Title and risk in the products shall pass to you upon the same being unloaded at the delivery address.

You acknowledge that we may use third party carriers or couriers to do so as your agent and at your risk and cost. We do not control these third party carriers or couriers and their terms of carriage shall apply to their delivery.

Consider delivery to a work address. Please state work hours and all information such as business name, address, building number and level.

In addition to the price of products ordered, you shall pay us a delivery fee. This fee covers the costs associated with packing and delivery of your order.

10. Returns, Delivery Errors or Damaged Products
As our products are normally perishable, they are not returnable.
If a product is delivered to you in a damaged condition, not delivered to you, or you receive a product that you have not ordered, then you must contact us within 48 hours of receipt of the goods. Claims made more than 48 hours after delivery will not be accepted.

When Deejays Ltd accepts responsibility for damaged or missing goods, Deejays Ltd will either, at its option, resupply the goods or credit or refund all or part of the purchase price of the goods. Credits requiring pickup must be communicated.

11. Disputes and Governing Law
All decisions pertaining to any dispute arising from the interpretation of the terms and conditions will be made by Deejays Ltd, whose decision will be final and binding on all customers and suppliers.

These terms and conditions and Online Services are governed by New Zealand law.
